Terms of Service

These Terms of Service ("Terms") govern access to and use of dualforceOS, the chat-first workspace operated by ThinkPrompt ("ThinkPrompt", "we", "us").

1. Acceptance of these Terms

By creating an account, accessing, or using dualforceOS on the web, desktop, or mobile app (the "Service"), you agree to be bound by these Terms and by our Privacy Policy. If you are agreeing on behalf of a company, you confirm you have authority to bind that company, and "you" refers to that company.

If you do not agree to these Terms, do not use the Service.

2. Eligibility and accounts

The Service is intended for business use. You must be at least 18 years old to create an account.

You sign in with Google or with an email and password through Firebase Authentication. We do not store your password; it is held by Firebase. On sign-up we collect your full name, email address, and your acceptance of these Terms, and we require email verification before you can use the Service.

You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us promptly if you suspect unauthorized use.

3. The Service

dualforceOS lets a company hire AI agents ("bots") as teammates inside shared chat rooms. Bots can converse, create and update tasks, documents, quotes, and orders, run routines on a schedule, and, where a company enables it, use a sandboxed cloud computer and browser to carry out a task.

Bots can connect to third-party integrations that you explicitly authorize (for example, calendar, email, or storage providers). You control which integrations are connected and can disconnect them at any time.

We may add, change, or remove features of the Service, including specific bot capabilities or plan limits, at any time. We will make reasonable efforts to tell affected customers of material changes in advance.

4. Your content and workspace data

You retain ownership of the content you and your team put into the Service: messages, tasks, documents, files, customer and order records, voice notes, and any other workspace content ("Your Content").

You grant ThinkPrompt a worldwide, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate, maintain, and improve the Service for you, including sending relevant parts of Your Content to AI model providers as described in the Privacy Policy to generate bot responses.

You are responsible for Your Content and for having the rights needed to submit it, including any customer, employee, or third-party data your team enters into the Service.

5. AI-generated output

Bot replies, generated documents, quotes, orders, task suggestions, and other AI-generated output ("Output") are produced by third-party AI model providers based on the instructions and context you and your bots supply. Output may be incomplete, inaccurate, or unsuitable for a particular purpose.

You are responsible for reviewing Output before relying on it, sending it to a customer, or using it to make a business decision, especially where it affects money, legal obligations, or another person.

We do not guarantee that Output will be accurate, complete, or error-free, and Output is provided "as is".

6. Acceptable use

When using the Service, you agree not to:

  • break any applicable law, or infringe the intellectual property, privacy, or other rights of any person;
  • upload malware, attempt to gain unauthorized access to the Service or its infrastructure, or interfere with its normal operation;
  • use the sandboxed cloud computer or browser to attack, scan, or gain unauthorized access to systems you do not own or have permission to test;
  • use the Service to generate content that is unlawful, deceptive, or intended to harass, defraud, or harm others;
  • reverse-engineer the Service except to the extent applicable law expressly permits it;
  • resell or provide the Service to a third party as your own product without our written agreement.

7. Third-party services and integrations

The Service relies on and connects to third-party providers, including AI model providers, cloud infrastructure, and any integrations you authorize. Those providers have their own terms and privacy practices, and your use of an integration is also subject to that provider's terms.

We are not responsible for the acts, omissions, availability, or content of third-party services, but we choose providers we reasonably believe are suitable for operating the Service.

8. Plans, fees, and billing

dualforceOS is offered under several plans (currently Free, Starter, Growth OS, and Enterprise) with different features and usage limits. Paid plans are billed at the fees shown at the time of purchase.

Fees are exclusive of applicable taxes unless stated otherwise. Except where required by law or stated in an order, fees are non-refundable.

We may change plan pricing or features on a going-forward basis; we will give notice before a change takes effect for your then-current subscription term.

9. Intellectual property

ThinkPrompt owns the Service, including its software, design, and the dualforceOS name and logo. Except for the rights expressly granted in these Terms, no rights are transferred to you.

Subject to Section 4, you retain all rights in Your Content, and we claim no ownership of it.

10. Confidentiality

Each party may access non-public information of the other in connection with the Service. Each party agrees to use the other's confidential information only to perform its obligations or exercise its rights under these Terms, and to protect it with reasonable care.

11. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate access to the Service if you materially breach these Terms, create risk or legal exposure for us, or if required by law, with notice where reasonably possible.

On termination, your right to use the Service ends. We will make reasonable efforts to let you export Your Content for a limited period after termination, except where legal or security reasons prevent this.

12. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, ThinkPrompt will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws principles. The parties will first try to resolve any dispute arising from these Terms or the Service in good faith; failing that within 30 days, the dispute will be subject to the jurisdiction of the competent courts of Ho Chi Minh City, Vietnam, unless applicable law gives you the right to bring a claim in your local courts.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you, for example by email or an in-product notice, before the changes take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
